End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and 108Themes ("Company," "we," or "us") for the use of our software, themes, templates, and related services provided through 108themes.com. By accessing or using our products, you agree to be bound by the terms of this EULA. If you do not agree, do not use our products or services.
1. License Grant
Subject to the terms of this EULA, 108Themes grants you a non-exclusive, non-transferable, limited license to use our software, themes, and templates for personal or commercial purposes, as specified in the product’s documentation or purchase agreement. This license does not permit you to sublicense, distribute, or modify the products except as expressly allowed.
2. Restrictions
You may not:
- Copy, distribute, or share our products beyond the scope of the license.
- Modify, reverse-engineer, decompile, or disassemble any part of the products.
- Use the products for any illegal or unauthorized purpose.
- Remove or alter any copyright, trademark, or proprietary notices included in the products.
3. Ownership
All intellectual property rights in the software, themes, and templates remain with 108Themes or its licensors. You are granted only a license to use the products, not ownership.
4. Updates and Support
We may provide updates, bug fixes, or support for our products at our discretion. For support inquiries, contact us at support@108themes.com. We do not guarantee the availability of updates or support unless specified in your purchase agreement.
5. Termination
This EULA is effective until terminated. We may terminate your license if you breach any terms of this agreement. Upon termination, you must cease all use of the products and destroy any copies in your possession.
6. Disclaimer of Warranties
Our products are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the products will meet your requirements or operate without interruption or errors.
7. Limitation of Liability
To the fullest extent permitted by law, 108Themes shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products, even if advised of the possibility of such damages.
8. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under this EULA shall be resolved in the state or federal courts located in California.

10. Changes to this EULA
We reserve the right to modify this EULA at any time. Changes will be effective upon posting to 108themes.com. Your continued use of our products after such changes constitutes your acceptance of the updated EULA.
